REGULAMIN KONKURSU „Być kobietą”

§1. Postanowienia ogólne

  1. Organizatorem konkursu „Być kobietą” (dalej: „Konkurs”) jest Gonzalo Acosta PayTech, Nowe Gizewo 7, 12-100 Nowe Gizewo, NIP 5833225458 (dalej: „Organizator”).
  2. Partnerem Konkursu oraz fundatorem części nagród jest Varsovian, ul. Nowy Świat 34, 00-393 Warszawa, NIP 1132456654 (dalej: „Partner”).
  3. Konkurs nie jest w żaden sposób sponsorowany, wspierany, administrowany ani powiązany z serwisem Instagram. Serwis Instagram nie ponosi odpowiedzialności za organizację i przebieg Konkursu.
  4. Konkurs prowadzony jest na profilach:
  5. Konkurs trwa od dnia 02.03.2026 r. do dnia 07.03.2026 r. do godziny 23:59.
  6. Wyniki Konkursu zostaną ogłoszone do dnia 17.03.2026 r. na profilu @acosta__studio.
  7. Konkurs ma charakter przyrzeczenia publicznego w rozumieniu art. 919–921 Kodeksu cywilnego.

§2. Warunki uczestnictwa

  1. W Konkursie mogą wziąć udział osoby fizyczne, które:
    • ukończyły 18 lat,
    • posiadają publiczne konto w serwisie Instagram,
    • mieszkają na terytorium Rzeczypospolitej Polskiej.
  2. Konkurs skierowany jest do kobiet, a jego celem jest celebracja kobiecości oraz wartości z nią związanych.
  3. Warunkiem udziału w Konkursie jest udzielenie odpowiedzi na pytanie konkursowe: „Co sprawia, że czujesz się sobą?” w maksymalnie 2–3 zdaniach w komentarzu pod rolką konkursową opublikowaną na profilu @acosta__studio do dnia 07.03.2026 roku.
  4. Jeden Uczestnik może dodać jeden komentarz konkursowy. W przypadku dodania większej liczby komentarzy, pod uwagę brany będzie wyłącznie pierwszy z nich.
  5. Udział w Konkursie jest dobrowolny i bezpłatny.
  6. Z Konkursu wyłączeni są pracownicy oraz współpracownicy Organizatora i Partnera, a także członkowie ich najbliższych rodzin.
  7. Uczestnik oświadcza, że jest wyłącznym autorem zgłoszonej odpowiedzi i posiada do niej pełne prawa. Organizator zastrzega sobie prawo do wykluczenia zgłoszeń naruszających dobre obyczaje lub prawa osób trzecich.

§3. Zasady wyłonienia zwycięzców i Prawa Autorskie

  1. Spośród wszystkich zgłoszeń Organizator wybierze 3 (trzy) najciekawsze odpowiedzi według własnej, subiektywnej oceny.
  2. Ocenie podlegać będzie kreatywność, oryginalność oraz zgodność z tematem Konkursu. Decyzje Organizatora są ostateczne.
  3. Każdy Uczestnik może otrzymać tylko jedną nagrodę.
  4. Zwycięzcy zostaną poinformowani o wygranej za pośrednictwem wiadomości prywatnej na Instagramie przez profil @acosta__studio.
  5. Zwycięzca zobowiązany jest w terminie 3 dni od otrzymania wiadomości przesłać dane niezbędne do wysyłki nagrody (imię, nazwisko, adres do doręczenia na terenie RP, numer telefonu).
  6. W przypadku braku odpowiedzi w wyznaczonym terminie lub podania błędnych danych, nagroda przepada, a Organizator może wybrać innego Zwycięzcę.
  7. Z chwilą ogłoszenia wyników, laureat udziela Organizatorowi nieodpłatnej licencji na publikację nagrodzonej odpowiedzi na profilu @acosta__studio oraz profilu Partnera w celach promocyjnych.

§4. Nagrody

  1. Nagrodami w Konkursie są:
    • Miejsce 1: Chusta jedwabna 90×90 „Syrenka Warszawska w odwiedzinach u siostry w Kopenhadze” Varsovian oraz Patera Scallop Red Acosta. Wartość nagrody: 889,00 zł brutto.
    • Miejsce 2: Zestaw filiżanek OTTO Acosta (2 szt.). Wartość nagrody: 240,00 zł brutto.
    • Miejsce 3: twilly „Kompozycja Warszawska” 120×7 Varsovian. Wartość nagrody: 189,00 zł brutto.
  2. Nagrody zostaną wysłane na koszt Organizatora w terminie do 14 dni od otrzymania danych. Wysyłka odbywa się wyłącznie na terenie Polski.
  3. Nagrody nie podlegają wymianie na ekwiwalent pieniężny ani na inną nagrodę.
  4. Nagrody w Konkursie korzystają ze zwolnienia z podatku dochodowego od osób fizycznych zgodnie z art. 21 ust. 1 pkt 68 ustawy o PIT.

§5. Dane osobowe

  1. Administratorem danych osobowych Uczestników jest Organizator.
  2. Dane osobowe Zwycięzców będą przetwarzane wyłącznie w celu realizacji Konkursu i wydania nagrody (art. 6 ust. 1 lit. b i f RODO).
  3. Dane będą przechowywane przez okres niezbędny do realizacji Konkursu i obowiązków podatkowych.
  4. Uczestnikom przysługuje prawo dostępu do danych, ich poprawiania lub żądania usunięcia.
  5. Dane Zwycięzców zostaną udostępnione firmie kurierskiej wyłącznie w celu realizacji dostawy.

§6. Reklamacje

  1. Reklamacje dotyczące Konkursu można składać drogą elektroniczną na adres:

    2. w terminie 14 dni od dnia ogłoszenia wyników.

  2. Reklamacja powinna zawierać imię, nazwisko oraz opis zastrzeżeń.
  3. Reklamacje będą rozpatrywane w terminie 14 dni od ich otrzymania.

§7. Postanowienia końcowe

  1. Organizator zastrzega sobie prawo do przerwania lub zakończenia Konkursu w przypadku wystąpienia przyczyn niezależnych (siła wyższa).
  2. Organizator nie ponosi odpowiedzialności za nieprawidłowe działanie serwisu Instagram, w tym za niedostarczenie wiadomości prywatnych lub opóźnienia w wyświetlaniu komentarzy.
  3. Ewentualne zmiany Regulaminu nie mogą naruszać praw nabytych Uczestników.
  4. W sprawach nieuregulowanych zastosowanie mają przepisy Kodeksu cywilnego.
  5. Regulamin dostępny jest w opisie konkursu na profilu @acosta__studio oraz na stronie internetowej www.acostastudio.pl.

TERMS AND CONDITIONS OF THE „BEING A WOMAN” CONTEST

§1. General Provisions

  1. The organizer of the „Being a Woman” contest (hereinafter: the „Contest”) is Gonzalo Acosta PayTech, Nowe Gizewo 7, 12-100 Nowe Gizewo, NIP: 5833225458 (hereinafter: the „Organizer”).
  2. The partner of the Contest and the founder of part of the prizes is Varsovian, ul. Nowy Świat 34, 00-393 Warsaw, NIP: 1132456654 (hereinafter: the „Partner”).
  3. The Contest is in no way sponsored, endorsed, administered by, or associated with Instagram. Instagram is not responsible for the organization or conduct of the Contest.
  4. The Contest is conducted on the following profiles:
  5. The Contest runs from March 2, 2026, until March 7, 2026, at 11:59 PM.
  6. The Contest results will be announced by March 17, 2026, on the @acosta__studio profile.
  7. The Contest constitutes a public promise within the meaning of Art. 919–921 of the Polish Civil Code.

§2. Conditions of Participation

  1. The Contest is open to natural persons who:
    • Are at least 18 years old,
    • Have a public Instagram account,
    • Reside within the territory of the Republic of Poland.
  2. The Contest is addressed to women, and its goal is to celebrate femininity and its associated values.
  3. To enter the Contest, participants must answer the contest question: „What makes you feel like yourself?” in a maximum of 2–3 sentences in a comment under the contest reel published on the @acosta__studio profile by March 7, 2026.
  4. Each Participant may submit only one contest comment. In the event of multiple comments, only the first one will be considered.
  5. Participation in the Contest is voluntary and free of charge.
  6. Employees and associates of the Organizer and Partner, as well as their immediate family members, are excluded from participating.
  7. The Participant declares that they are the sole author of the submitted response and hold full rights to it. The Organizer reserves the right to exclude entries that violate good customs or the rights of third parties.

§3. Selection of Winners and Copyrights

  1. The Organizer will select 3 (three) most interesting responses from all submissions based on its own subjective assessment.
  2. Entries will be judged on creativity, originality, and relevance to the Contest theme. The Organizer’s decisions are final.
  3. Each Participant may receive only one prize.
  4. Winners will be notified of their win via direct message (DM) on Instagram from the @acosta__studio profile.
  5. The Winner is obliged to provide the data necessary for shipping the prize (first name, last name, delivery address in Poland, phone number) within 3 days of receiving the message.
  6. Failure to respond within the specified time or providing incorrect data will result in forfeiture of the prize, and the Organizer may select a different Winner.
  7. Upon the announcement of the results, the winner grants the Organizer a royalty-free license to publish the winning response on the @acosta__studio and Partner profiles for promotional purposes.

§4. Prizes

  1. The prizes in the Contest are:
    • 1st Place: Varsovian silk scarf 90×90 „Warsaw Mermaid visiting her sister in Copenhagen” and an Acosta Scallop Red Platter. Total prize value: 889.00 PLN gross.
    • 2nd Place: Acosta OTTO cup set (2 pcs). Total prize value: 240.00 PLN gross.
    • 3rd Place: Varsovian „Warsaw Composition” twilly 120×7. Total prize value: 189.00 PLN gross.
  2. Prizes will be shipped at the Organizer’s expense within 14 days of receiving the shipping data. Shipping is available only within Poland.
  3. Prizes are not exchangeable for cash or any other prize.
  4. Contest prizes are exempt from personal income tax (PIT) in accordance with Art. 21 sec. 1 item 68 of the PIT Act.

§5. Personal Data

  1. The administrator of the Participants’ personal data is the Organizer.
  2. Winners’ personal data will be processed solely for the purpose of conducting the Contest and delivering the prizes (Art. 6 sec. 1 lit. b and f of the GDPR).
  3. Data will be stored for the period necessary to complete the Contest and fulfill tax obligations.
  4. Participants have the right to access, correct, or request the deletion of their data.
  5. Winners’ data will be shared with the courier company solely for delivery purposes.

§6. Complaints

  1. Complaints regarding the Contest can be submitted via email to:

    2. within 14 days from the date of the announcement of results.

  2. The complaint should include the participant’s first name, last name, and a description of the grievances.
  3. Complaints will be reviewed within 14 days of receipt.

§7. Final Provisions

  1. The Organizer reserves the right to interrupt or terminate the Contest in the event of unforeseen circumstances (force majeure).
  2. The Organizer is not responsible for malfunctions of the Instagram service, including non-delivery of private messages or delays in displaying comments.
  3. Any changes to these Terms and Conditions shall not violate the acquired rights of the Participants.
  4. For matters not regulated herein, the provisions of the Polish Civil Code shall apply.
  5. These Terms and Conditions are available in the contest description on the @acosta__studio profile and at www.acostastudio.pl.
